01About these terms#
These terms apply when you use MedTality ("MedTality", "we", "us"): this website, the web app and the mobile app, together the "service". By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
If you use MedTality for an organization, you agree on its behalf and confirm you are allowed to, and "you" includes that organization.
These documents are part of these terms: our privacy policy, which explains how we handle your information, and our Assessment and AI policy, which explains how assessments are run and scored. An organization with a signed order form, staffing agreement or Business Associate Agreement is also bound by it, and where it conflicts with these terms, the signed document controls.
02What MedTality does#
MedTality:
- publishes standards for healthcare roles, built from the certification frameworks for each one;
- assesses candidates against those standards in spoken assessments, and shows the results as scorecards and verdicts;
- issues credentials anyone can check with a code;
- matches candidates with employers' roles, and gives employers tools to review, interview and hire;
- runs credentialing programs for organizations, and Virtual Staff programs that place candidates with practices;
- offers courses, pathways and practice to candidates.
MedTality identifies and assesses talent. We are not an employer of the candidates on MedTality unless a staffing contract says so, we do not make hiring decisions, and we do not guarantee a job, an interview or a hire to any candidate, or a candidate to any employer.
MedTality is not a licensing or certification body. A score, verdict or credential is not a license to practice and does not replace any license, certification or registration the law requires for a role.
03Your account#
- Who can join. You must be at least 18, and able to make a binding contract, to use MedTality.
- One person, one account. Your account is yours alone and may not be shared, sold or transferred.
- Keep it secure. Keep your sign-in details private, and we recommend turning on two-step sign-in. Tell us through Support if you think someone else has used your account. You are responsible for what happens under it until you do.
- Accurate details. Keep your profile, credentials and organization details true, complete and up to date.
- Messages from us. You agree to receive the emails, texts and notifications needed to run your account, such as sign-in codes and updates on your applications. You choose which others you receive in Settings.
04For candidates#
Taking assessments
- Take every assessment yourself, alone, in your own words.
- Do not use notes, other people, AI tools or anything else to answer for you, and do not record, copy or share the questions or scenarios.
- Do not mention real patients' names or other details that could identify them. Describe what you would do, not who you did it for.
- Each assessment allows a set number of attempts and a waiting time between them, which the app shows you before you start. An attempt counts only once the examiner finishes it, and once you pass, the assessment is complete.
Your results
A score and verdict reflect the evidence in that attempt, measured against the standard as it stood at the time. If an attempt shows signs it was answered with help, its credential is held until you sit it again. If we find an attempt broke these terms, we may withdraw its results and any credential it earned. You can ask us to look again at any verdict, as the Assessment and AI policy explains.
Applying
When you apply for a role, you agree that the employer can see your profile and the scorecards for that role. If you leave "Apply for me" on, you authorize us to apply on your behalf to open roles you are ready for and hold every required credential for, on the same terms. You can withdraw an application, or turn "Apply for me" off in Settings, at any time.
05For employers#
Your decisions
- You make the decisions. Your organization decides who to interview and hire. Use scorecards as one piece of evidence alongside your own judgment, and do not rely on them as the only basis for a decision.
- Hire fairly. Follow the employment, anti-discrimination and labor laws that apply to you, and post only real roles you mean to fill, with accurate pay and requirements.
- Automated tools. Some places regulate tools that help make hiring decisions, such as New York City's rules on automated employment decision tools. Where they apply to you, you are responsible for meeting them, including any notice to candidates. We will give you the information about how scoring works that you need to do so.
- Check what the law requires. Confirm each hire holds the licenses and registrations the role requires where they will work. A MedTality credential does not replace that check.
Candidate information
Use what you see about candidates only to recruit for your roles, keep it confidential and secure, and do not copy it out of MedTality for any other purpose, sell it or share it with anyone outside your organization. Follow any law that applies to your own handling of candidates' information, such as background check and privacy laws.
Your organization
You are responsible for the people you invite to your organization, the access you give them, and what they do in it. Remove people when they no longer need access. Do not upload patients' health information to MedTality, including in role documents and messages.
06Credentialing and Virtual Staff#
Credentialing programs
An organization can run a program that invites its staff, new hires or students to take an assessment and earn its credential. The organization chooses the role, the competencies and how long the credential stays valid. It is responsible for having the right to invite each person and for how it uses their results, and it sees each person's progress and results in the program.
Virtual Staff
Virtual Staff places candidates, who may live outside the United States, with practices whose working hours overlap theirs. Each placement has a staffing contract that sets out who employs and pays the worker, the pay, the hours and the worker classification, and that contract governs the placement where it differs from these terms.
A practice that gives a placed worker access to patient records signs our Business Associate Agreement first. The practice controls that access, through its own systems, and is responsible for confirming that remote and international access is allowed by its contracts with health plans and by the law that applies to it. A placed worker follows the practice's policies and the agreement while they work, and keeps patient information inside the practice's systems.
07Fair use#
When you use MedTality, do not:
- pretend to be someone else, or misstate your identity, credentials or experience, or upload a document that is not genuine;
- harass, threaten, deceive or discriminate against anyone, in messages or anywhere else, or use MedTality to recruit for anything other than real healthcare roles;
- try to get around the assessments, scoring or verification, try to make the examiner or scorer act outside its instructions, or help someone else do so;
- upload patients' health information, malware, or anything you do not have the right to share;
- scrape, copy, resell or build a competing product from the service, the standards, the assessments or other people's information;
- break, overload, probe or reverse engineer the service, or reach parts of it you were not given access to, except as our security page allows for good-faith research;
- break the law, or help anyone else do so.
08Plans and billing#
What you can buy
- Free for candidates. Building a profile, taking the assessment, seeing your scorecard, matching and applying cost nothing.
- Gold Standard Credential. A one-time payment for a credential, issued when you pass the assessment it covers. It never renews.
- Candidate Learning. A monthly subscription to courses, pathways and practice. Some courses can also be bought on their own.
- Employer Team. A monthly subscription for an organization, with the seats and open roles shown on our pricing page. Nothing is charged per applicant or per hire.
- Health systems. Credentialing programs, Virtual Staff and larger plans are priced in an order form.
Payment
Prices are in US dollars and are shown before you pay. Payments are taken by Stripe, and by paying you also agree to its terms. A subscription renews automatically each month, and is charged to the same payment method, until you cancel. If a payment fails, we may pause what it pays for until it succeeds. We will tell you before a price change applies to a subscription you already have, and you can cancel before it does.
Cancelling and refunds
You can cancel a subscription in Settings. It stays active until the end of the period you have paid for and then stops; you are not charged again. Unless the law gives you a right to one, payments are not refunded. If we do refund a payment, what it paid for ends: a refunded credential is withdrawn, and a refunded course closes.
09Credentials#
A credential shows that you passed an assessment against a standard on the date it was issued. Each one can be checked by anyone with its code at medtality.com/verify-a-credential, which shows its title, its status and its dates, but not your name.
A Gold Standard Credential does not expire. A credential from an organization's program lasts as long as that program sets. We may withdraw a credential that was earned in breach of these terms, paid for with a payment that was refunded or reversed, or issued in error, and a check of its code will then show it as withdrawn.
10Content and license#
You keep ownership of what you add to MedTality, such as your profile, resume, documents and messages. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process and show it to run the service for you and for the people you share it with, for as long as we keep it under our privacy policy. You confirm you have the right to share it.
The service, the standards, the assessments, the scenarios, our courses and our other materials belong to MedTality and its licensors. We let you use them for your own job search, learning or hiring while these terms apply, and for nothing else. Our names and logos may not be used without our permission.
If you send us feedback or ideas, we may use them without any duty to you.
11Other services#
MedTality connects to services we do not run, such as Google, Apple and LinkedIn for signing in, Google and Microsoft calendars, video meeting links, and Stripe for payment. Your use of each is governed by its own terms, and we are not responsible for it. Links to other websites are given for convenience and do not mean we endorse them.
12Disclaimers#
We work hard to make scoring fair and accurate, but AI can make mistakes, and a verdict reflects the evidence in one attempt. MedTality is provided as it is and as available. To the extent the law allows, we make no promises beyond those in these terms, including that the service will be uninterrupted or free of errors, that any result will suit a particular purpose, or that any candidate or employer is who or what they say.
Nothing on MedTality is medical or legal advice. Nothing in these terms limits rights you have by law that cannot be limited.
13Limitation of liability#
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, such as lost earnings, profits, business or data, and our total liability to you for all claims is limited to the greater of what you paid us in the 12 months before the claim arose and US $100.
These limits do not apply to liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.
14Indemnity#
If you use MedTality for an organization, the organization will defend MedTality against claims by others that arise from its hiring decisions, its job postings, its handling of candidates' information or its breach of these terms, and pay any resulting costs and damages.
15Ending your use#
You can stop using MedTality and delete your account from Settings at any time. We may suspend or close an account that breaks these terms, puts other people at risk or exposes us to legal risk, and we will tell you why unless the law or someone's safety prevents it. If you think we got it wrong, tell us through Support.
When your account ends, your right to use the service ends with it, and what happens to your information is set out in our privacy policy. Sections that by their nature should last, such as those on content, disclaimers, liability, indemnity and disputes, continue to apply.
16Disputes#
If you have a concern, tell us through Support first, and we will try to resolve it with you informally. If we cannot resolve it within 60 days, either of us may take it further under the law and in the courts that govern these terms. Nothing here stops you from going to a small claims court or a regulator, or takes away a right your local law gives you to bring a claim where you live.
17General#
- Whole agreement. These terms, with the documents they name, are the whole agreement between you and MedTality about the service.
- Transfer. You may not transfer these terms without our consent. We may transfer them, with notice to you, to a business that takes over the service and keeps to them.
- Events beyond control. Neither of us is responsible for delays or failures caused by events beyond our reasonable control.
- If a part fails. If part of these terms cannot be enforced, the rest still applies, and not enforcing a term is not giving it up.
- Language. These terms are written in English. If they are translated, the English version applies unless local law says otherwise.
18Changes to these terms#
When these terms change, we will update the date at the top of the page. If a change matters to how you use MedTality, we will tell you in the app or by email at least 30 days before it takes effect, unless the law requires a change sooner. Using the service after that means you accept the new terms; if you do not, you can delete your account.
